1. Scope of this policy
This Privacy Policy applies to personal information processed by AJILE Development Co, LLC (“AJILE,” “we,” “us,” or “our”) when you visit https://www.ajiledevs.com and any page that links to this policy (the “Site”), use our free tools such as cost calculators, submit a form, book a call, subscribe to our emails, or otherwise interact with us in connection with our ecommerce development and consulting services (the “Services”).
We are a business-to-business services company. Most of the people we interact with do so in a professional capacity. This policy applies to that information as well.
This policy does not cover personal information we process on behalf of our clients as a service provider or processor (for example, customer data inside a storefront we build or maintain). That processing is governed by our agreement with the client and the client’s own privacy policy.
2. Information we collect
Information you provide to us
- Contact and business details — name, email address, company name, website, job title, phone number, country, team size, and how you heard about us, when you complete a contact or enquiry form.
- Calculator and assessment inputs — information you enter into our free tools, such as estimated annual revenue, current commerce platform and plan, payment processor, and number of apps, together with the results the tool generates.
- Booking details — when you schedule a call through our booking tool, the name, email, time-zone, and any notes you submit.
- Account information — if we offer an account area, the credentials and profile information you register with.
- Communications — the contents of emails, chat messages, call notes, and, with your consent, call recordings and transcripts.
- Newsletter subscription — your email address if you subscribe to updates.
Information collected automatically
- Device and usage data — IP address, browser type and version, operating system, device identifiers, referring URLs, pages viewed, time on page, clicks, scrolls, and similar interaction data.
- Attribution data — campaign identifiers attached to the link you arrived on, including Google click ID (
gclid), Meta click ID (fbclid), Microsoft click ID (msclkid), LinkedIn click ID, UTM parameters, the first page you landed on, and the referring site. We store these in a first-party cookie and browser storage for up to 90 days so we can tell which campaign a later enquiry came from. - Session replay and heatmaps — with our analytics providers we may record how you move through a page (mouse movement, scrolling, clicks, taps). Form fields and other sensitive inputs are masked before recording.
Information from other sources
- Publicly available business information (for example, company websites and professional networking profiles) used to understand your business before a call.
- Referrals from existing clients or partners who introduce you to us.
- Data-enrichment, CRM, and advertising platforms that provide aggregated or matched information about your company or engagement with our campaigns.
We do not intentionally collect sensitive personal information (such as government identifiers, precise geolocation, financial account numbers, health data, or data revealing racial or ethnic origin, religion, or sexual orientation) and ask that you do not submit it through the Site.
3. How we use information
We use personal information to:
- Respond to enquiries, schedule and hold discovery calls, prepare proposals, and deliver the Services.
- Operate our free tools and return results to you, and follow up on those results where you have asked us to or where we have a legitimate business reason to.
- Send booking confirmations, reminders, and other transactional or service messages.
- Send marketing communications such as case studies, workshop invitations, and newsletters, subject to your right to opt out.
- Measure and improve the Site and our campaigns, including understanding which advertising campaign or keyword led to an enquiry, a booked call, or a signed engagement.
- Show you advertising on other platforms after you visit the Site (retargeting), as described in Sections 4 and 6.
- Detect, prevent, and investigate fraud, abuse, security incidents, and violations of our Terms of Service.
- Comply with legal obligations, enforce our agreements, and protect our rights and the rights of others.
Where the EU or UK General Data Protection Regulation applies, our legal bases are: performance of a contract or steps at your request before entering a contract; our legitimate interests in running and promoting our business, securing the Site, and measuring our marketing; your consent, where we ask for it (for example, non-essential cookies and call recording); and compliance with legal obligations.
6. Sale, sharing & targeted advertising
We do not sell personal information for money. However, several US state privacy laws define “sale,” “sharing,” and “targeted advertising” broadly enough to include letting advertising platforms set cookies or receive identifiers so they can show you our ads elsewhere or measure our campaigns.
Under those definitions, we “share” and use for “targeted advertising” the following categories: identifiers (such as cookie IDs, click IDs, IP address, and hashed email address), internet and other electronic activity (pages visited, events such as completing a calculator or booking a call), and commercial information (such as the calculator inputs and results that inform campaign optimisation). Recipients are the advertising platforms listed in Section 4.
Opting out. You can opt out of sharing and targeted advertising by: enabling Global Privacy Control in your browser; using the cookie banner where shown; using the platform-level opt-out links in Section 4; or emailing privacy@ajiledevs.com with the subject line “Do Not Sell or Share.” We do not knowingly sell or share the personal information of anyone under 16.
We do not use personal information for profiling in furtherance of decisions that produce legal or similarly significant effects.
7. Data retention
We keep personal information only as long as reasonably necessary for the purposes described in this policy, which depends on the type of data and why we have it:
- Leads and enquiries that do not become clients — generally up to 24 months from our last interaction, so we can respond if you come back, unless you ask us to delete them sooner.
- Client records — for the term of the engagement and up to 7 years afterwards to meet accounting, tax, and contractual obligations.
- Attribution cookies — 90 days.
- Analytics and session recordings — per provider defaults we configure, typically 2 to 14 months, then aggregated or deleted.
- Call recordings and transcripts — generally up to 12 months, or shorter on request.
- Marketing lists — until you unsubscribe, after which we keep a suppression record so we do not email you again.
We may keep information longer where required by law, to resolve disputes, or to enforce our agreements, and we may retain de-identified or aggregated data indefinitely.
8. Security
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit (TLS), access controls and least-privilege access to our systems, reputable infrastructure providers, and vendor due diligence. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we learn of a security breach affecting your personal information, we will notify you and any applicable regulator as required by law, including Florida’s Information Protection Act.
9. Your US state privacy rights
Residents of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, and other states with comprehensive privacy laws may have some or all of the following rights, subject to the thresholds, exceptions, and verification requirements of the applicable law. Even where a law does not technically apply to us, we will honour these requests as a matter of practice where reasonably feasible.
- Know / access — confirm whether we process your personal information and obtain a copy of it, including the categories collected, sources, purposes, and categories of third parties it was disclosed to.
- Correct — have inaccurate personal information corrected.
- Delete — have personal information deleted, subject to legal exceptions.
- Portability — receive your information in a portable and, where technically feasible, readily usable format.
- Opt out — of the sale of personal information, sharing or processing for targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects (see Section 6).
- Limit use of sensitive personal information — we do not collect sensitive personal information for purposes that would require this right, but will honour it if that changes.
- Non-discrimination — we will not deny you services, charge different prices, or provide a different level of service because you exercised a privacy right.
- Appeal — if we decline a request, you may appeal by replying to our decision; we will respond within the time the applicable law allows. If the appeal is denied you may contact your state attorney general.
How to exercise your rights
Email privacy@ajiledevs.com with the subject line “Privacy Request,” or write to us at the address in Section 16. Tell us which right you are exercising and the email address you used with us so we can locate your records. We will verify your identity by matching the details you provide against our records and may ask for additional information where necessary. You may designate an authorised agent to make a request on your behalf; we may require proof of the agent’s authority and direct confirmation from you. We will respond within 45 days (extendable by a further 45 days where permitted and with notice to you). We do not charge a fee for requests unless they are manifestly unfounded or excessive.
California notice at collection and additional disclosures
For California residents, the categories of personal information we have collected in the preceding 12 months, as defined by the California Consumer Privacy Act (as amended by the CPRA), are: identifiers; personal information categories listed in the California Customer Records statute (Cal. Civ. Code §1798.80(e)); commercial information; internet or other electronic network activity; geolocation data (approximate, derived from IP address); audio information (call recordings, with consent); professional or employment-related information; and inferences drawn from the above. Sources, purposes, and recipients are described in Sections 2, 3, and 5. Categories shared for cross-context behavioural advertising are described in Section 6. We do not use or disclose sensitive personal information for purposes other than those permitted by CCPA regulations §7027(m). California residents may also request, under Civil Code §1798.83 (“Shine the Light”), information about disclosures to third parties for their direct marketing purposes; we do not make such disclosures.
Nevada residents. We do not sell covered information as defined in NRS 603A. You may submit a request to opt out of any future sale at the email above.
10. Rights for EEA, UK & Swiss residents
If you are in the European Economic Area, the United Kingdom, or Switzerland, AJILE Development Co, LLC is the controller of your personal data for the purposes described in this policy. You have the right to access, rectify, erase, restrict, and port your personal data; to object to processing based on our legitimate interests, including direct marketing at any time; to withdraw consent at any time without affecting prior processing; and to lodge a complaint with your local supervisory authority (for the UK, the Information Commissioner’s Office; for Switzerland, the Federal Data Protection and Information Commissioner).
To exercise these rights, contact us at privacy@ajiledevs.com. We will respond within one month, extendable by two further months for complex requests with notice to you.
11. International transfers
We are based in the United States and process information there, and our service providers may process information in the US and other countries that may not provide the same level of data protection as your home jurisdiction. Where we transfer personal data from the EEA, UK, or Switzerland, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses and the UK International Data Transfer Addendum, or on a provider’s certification under the EU–US, UK, or Swiss–US Data Privacy Framework where applicable. You may request a copy of the relevant safeguards by contacting us.
12. Children's privacy
The Site and Services are intended for businesses and adults. We do not knowingly collect personal information from children under 16, and we do not knowingly sell or share the personal information of consumers under 16. If you believe a child has provided us with personal information, contact us and we will delete it.
13. Email, calls & recording
Marketing email. We send marketing email only to people who have enquired about our Services, subscribed, or with whom we have an existing business relationship, consistent with the CAN-SPAM Act and, where applicable, the GDPR and PECR. Every marketing email includes a working unsubscribe link, and we process opt-outs within 10 business days. Transactional messages (booking confirmations, reminders, replies to your enquiry) are not marketing and may continue after you unsubscribe.
Phone and text. If you give us a phone number we may call you about your enquiry. We will not send you automated marketing calls or text messages without your prior express written consent, which you may revoke at any time by replying STOP or telling us.
Call recording. Florida and several other states require all parties to consent to a recorded call. We will tell you at the start of any call we intend to record or transcribe and will not record if you object. Recordings and transcripts are used for note-taking, quality, and training our team, are stored with reputable providers, and are retained as described in Section 7.
14. Third-party sites & tools
The Site links to and embeds tools operated by third parties, including our calendar booking widget, analytics and advertising platforms, and social networks. Those parties have their own privacy policies, and this policy does not apply to information they collect directly. We encourage you to review their policies.
15. Changes to this policy
We may update this policy from time to time. We will post the revised version here and update the “Last updated” date. If the changes are material, we will provide additional notice, such as by email or a prominent notice on the Site, and where required we will seek your consent.
